Please read these Terms & Conditions carefully before using our services. By accessing our website or submitting information, you agree to be bound by these terms.
1) Acceptance of These Terms
By accessing or using nationalaccidentassist.com (the "Site") and any related forms, phone numbers, chat, SMS, or services (collectively, the "Services"), you agree to these Terms & Conditions (the "Terms"). If you do not agree, do not use the Services.
You also agree to our Privacy Policy (which explains how we collect and use data) and any additional policies referenced here. If there is a conflict between these Terms and any supplemental policy, these Terms control.
2) What We Do (Important Disclaimers)
- Information & Matching Service. National Accident Assist ("NAA," "we," "us," or "our") is a marketing and information platform that helps users understand accident-injury options and connect with independent lawyers and/or law firms who may be able to help.
- Not a Law Firm / No Legal Advice. We are not a law firm, we do not provide legal representation, and nothing on the Site is legal advice. The content is for informational and advertising purposes only.
- No Attorney–Client Relationship with NAA. Your use of the Services does not create an attorney–client relationship with NAA. If you connect with a lawyer or law firm, any attorney–client relationship will form only if and when you sign that lawyer's/firm's written engagement agreement.
- Attorney Advertising. This Site may be considered attorney advertising. Past results do not guarantee a similar outcome. Photos or testimonials may be illustrative and not actual clients.
- No Endorsement or Guarantee. We do not recommend or endorse any specific lawyer, law firm, or outcome. We do not guarantee that a lawyer will accept your matter or that you will obtain compensation.
3) Eligibility & Your Responsibilities
- Age & Location. You must be 18 or older and use the Services only where they are lawfully available.
- Accurate Information. You agree to provide true, accurate, and complete information and to update it as needed.
- Your Use. You will use the Services only for lawful purposes and consistent with these Terms.
4) How Matching Works; Fees & Compensation
- How We Match. With your permission, we may share your inquiry details with one or more participating lawyers/law firms ("Partners") so they can evaluate whether they can assist you.
- Compensation. We may receive marketing or advertising fees from Partners or other third parties for leads, calls, form submissions, or other permitted activities. Such fees do not affect the cost of any legal services you may obtain and do not constitute a recommendation.
- No Cost to You from NAA. We do not charge consumers a fee for using our matching Service. Any legal fees are between you and the lawyer/firm you choose and will be set out in that firm's engagement agreement.
5) Communications Consent (Phone, SMS, Email)
By submitting a form or otherwise providing your contact information, you expressly consent to be contacted by NAA and our Partners by phone, SMS/MMS text, email, and/or prerecorded or automated means, at any number or address you provide, even if it is on a federal or state Do-Not-Call registry. Message and data rates may apply.
- You may opt out of marketing texts at any time by replying STOP; for emails, use the unsubscribe link.
- Consent is not a condition of any purchase or legal representation.
- We may monitor, record, and retain communications for quality and compliance.
6) No Emergency Services
The Services are not for emergencies. If you need urgent help, call 911 or your local emergency number.
7) Privacy & Data
Your use of the Services is subject to our Privacy Policy, which explains our data practices, including how we collect, use, share, and retain information. Do not submit confidential or privileged information through the Site forms or chat; doing so does not create an attorney–client relationship with NAA.
8) User Conduct & Prohibited Uses
You agree not to:
- Provide false, misleading, or incomplete information.
- Interfere with the Site's security or operation, or attempt unauthorized access.
- Use the Services to harass, abuse, defame, or violate the rights of others.
- Copy, scrape, crawl, or harvest content except as allowed by these Terms or applicable law.
- Upload malicious code or disrupt our infrastructure.
9) Intellectual Property
The Site, including its design, text, graphics, logos, and other content, is owned by or licensed to NAA and is protected by intellectual-property laws. You may access and use the Site for personal, non-commercial purposes only. All rights not expressly granted are reserved.
10) Third-Party Content & Links
The Site may contain links to third-party websites or services (including Partners). We are not responsible for such third parties, their content, or their practices. Your dealings with third parties are solely between you and them.
11) Disclaimers of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
12) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NAA, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the extent any liability is found, our total aggregate liability to you for any claim arising from the Services shall not exceed USD $100.
(Some states do not allow certain limitations; in those jurisdictions, our liability shall be limited to the maximum extent permitted by law.)
13) Indemnification
You agree to defend, indemnify, and hold harmless NAA and our owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any law or third-party rights; or (d) any content or information you submit.
14) Electronic Signatures & Notices
You agree that electronic signatures, agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
15) Changes to the Services and Terms
We may modify, suspend, or discontinue any part of the Services at any time. We may update these Terms by posting a revised version on the Site with a new "Last updated" date. Your continued use after changes means you accept the updated Terms.
16) Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will survive.
17) Dispute Resolution; Arbitration; Class-Action Waiver
Please read this section carefully; it affects your rights.
- Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Venue & Governing Law. The arbitration shall take place by video/teleconference or in the State of Florida, unless you and NAA agree otherwise. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
- Class-Action Waiver. You and NAA agree to bring claims only in your or our individual capacities, and not as a plaintiff or class member in any purported class or representative action.
- Small-Claims Exception. Either party may bring an individual action in small-claims court instead of arbitration.
- Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@nationalaccidentassist.com within 30 days of your first use of the Services, stating your full name, address, phone number, and your desire to opt out.
18) Geographic Restrictions
We provide the Services from the United States and do not represent that they are appropriate or available in other locations. You are responsible for compliance with local laws.
19) Severability; Waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
20) Entire Agreement
These Terms, together with our Privacy Policy and any supplemental terms, constitute the entire agreement between you and NAA regarding the Services and supersede all prior or contemporaneous understandings.
